This Notice explains how Cargill uses Personal Information about job applicants. We refer to this as “Recruitment Information”. You may also have certain legal rights with respect to Recruitment Information. This Notice also summarizes what these are.
This Notice applies to applications submitted via Cargill’s careers website, including via the third party system named Taleo, third parties, such as recruitment agencies, job boards and other means, such as by post and email.
1. What recruitment information does Cargill collect?
Cargill will generally only collect Recruitment Information in the recruitment process that is necessary to assess you for the position for which you have applied. This includes the following categories:
- Application information: This information will generally tell us who you are and help build a picture of your capabilities and suitability for certain positions. This type of information may include your name, contact information, current company, information contained in your CV/resume (e.g. professional qualifications, previous employment history and personal interests and experiences), information contained in your social media accounts or personal websites or accounts (e.g. LinkedIn or Twitter), information about the type of work and projects you have been involved with and any other information you may wish to provide to us as part of your application;
- Recruitment process information: This is information collected as a result of the recruitment process, such as your performance at assessment centers or interview and information provided by your referees;
- Future opportunities information: This is information collected in order to keep in touch with you about future job opportunities at Cargill, such as your name, email, location, field of expertise and the kind of role you are interested in;
- Personal Information about criminal convictions or medical information will only be sought where permitted by applicable law.
Cargill generally receives Recruitment Information either (a) directly from you (for instance when you provide information as part of your application or during the recruitment process) or (b) from third parties (for instance from recruitment agencies). Cargill will indicate whether the information requested is mandatory or optional. Cargill will also explain the consequences should you decide not to provide information which Cargill has indicated is mandatory. In some circumstances this may mean Cargill is unable to process your application.
2. What will Cargill do with your recruitment information?
The main purposes for which Cargill uses your Recruitment Information include:
- Supporting and Processing your Application, for example, so Cargill can assess your ability to meet the job specification, in order to shortlist applicants and to verify references and professional qualifications provided by applicants.
- Improving Cargill’s Application Process, for example to ensure that the careers website is user-friendly and contains appropriate and helpful information.
- Security Management, for example to ensure the security of Cargill’s premises, assets, information, employees and other personnel.
- Legal and Regulatory Compliance, such as compliance with health & safety requirements and other legal or fiscal obligations, or in connection with litigation or an internal investigation or audit, as well as equal opportunities monitoring.
Cargill may verify the Recruitment Information you provide and/or collect Personal Information about you from third party sources to assist with “Pre-Employment Checks”. If this occurs:
- You will be told in advance which aspects of your Recruitment Information will be verified including an explanation of how the Pre-Employment Checks will be carried out; and
- Information about criminal convictions (if collected) or medical information will only be collected through official authorized sources and in accordance with applicable law.
Cargill may also require you to undertake drug and alcohol testing prior to commencing employment, in accordance with applicable law.
Cargill will only process your Recruitment Information where it has a legal basis for doing so. Generally, Cargill will be processing your Recruitment Information to help it decide whether to enter into an employment relationship or contract of employment with you. At other times, Cargill will be processing your Recruitment Information because you have consented to Cargill doing so. In which case you can withdraw such consent at any point.
Cargill may also process your Recruitment Information to comply with its legal obligations or because it is in Cargill’s legitimate business interests to do so (for example, where it is necessary to understand applicants in sufficient detail so Cargill can operate an effective recruitment process).
Cargill may process Personal Information relating to gender, race, ethnic origin or physical or mental health, where the processing is required to comply with local law and/or necessary to identify or keep under review the existence or absence of equality of opportunity or treatment.
3. Cargill data privacy principles
Cargill observes the following principles in relation to Recruitment Information:
- We process it fairly and lawfully;
- We process it for a specific legitimate business purpose and do not process in a manner incompatible with that purpose;
- We use Recruitment Information that is adequate, relevant and not excessive for the purpose for which it is processed;
- We keep it accurate and, as necessary, up to date;
- We keep it in a form which permits identification for no longer than necessary for the purpose for which it was collected;
- We protect it against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, using appropriate technical and organisational measures;
- We process it in accordance with an Individual’s rights.
4. Who is your recruitment information disclosed to?
(a) Within Cargill
Cargill restricts access to Recruitment Information to people within the company who have a “need to know” that information. For example, certain individuals within Cargill will have access to your Recruitment Information in order to process your application and manage the recruitment process (this may include individuals in Cargill’s Talent Acquisition team and individuals to whom you would report if your application is successful). As a global company doing business across national borders, there may be situations where this “need to know” requires your information to be transferred to Cargill in another country, including countries that may provide no or less legal protection for Personal Information.
Cargill has implemented a legal mechanism known as ‘Binding Corporate Rules’ to provide appropriate safeguards to protect Recruitment Information from the EEA when it is transferred to another Cargill company.
(b) Outside Cargill
Cargill shares Recruitment Information with authorized Third Party Service Providers to conduct and manage the recruitment process. For example, Cargill may share your Recruitment Information with such service providers in order to conduct screening and verification of your application and the information you have provided to us. This includes verifying academic and professional qualifications.
Please note that some of our Third Party Service Providers may be members of the EU-US Privacy Shield (see https://www.privacyshield.gov/list). It is also Cargill’s practice to require Third Party Service Providers to implement other means of providing appropriate safeguards for Personal Information transferred from the EEA where appropriate.
Beyond our Third Party Service Providers, generally, Cargill will only disclose your Employment Information outside Cargill and its Service Providers:
- when required to do so by law;
- in response to a legitimate request for assistance by the police or other law enforcement agency; and/or
- to seek legal advice from Cargill’s external lawyers or in connection with litigation with a third party.
5. How long will Cargill retain your recruitment information?
Cargill keeps your Recruitment Information in accordance with our internal retention policies and procedures. If you are unsuccessful in your application with us (or if you reject the position), Cargill will keep your Recruitment Information for no longer than is necessary for the specific recruitment process unless you agree to a different duration to enable Cargill to keep your Recruitment Information on file so that we may contact you again if another suitable position arises.
6. Where does Cargill store your recruitment information?
Recruitment Information may be transferred to, and stored at, a destination outside the originating country (including for EEA job applicants, outside the EEA) in countries, which have less strict, or no data protection laws. It may also be processed by staff or our vendors in other jurisdictions which also have less strict or no data protection laws.
Whenever Cargill transfers your Recruitment Information, we will take legally required steps to ensure that adequate safeguards are in place to protect your Recruitment Information and to make sure it is treated securely and in accordance with this Notice. If you are located in the EEA, you may contact us for a copy of the safeguards which Cargill has put in place to protect your Recruitment Information and privacy rights in these circumstances.
7. Exercising your rights
You may have the right to request access to, rectification or erasure of, the Recruitment Information Cargill holds about you. You may also have the right to object to or restrict certain types of processing of your Recruitment Information and request to receive a machine-readable copy of the Recruitment Information you have provided to us.
Any request to exercise one of these rights will be assessed by us on a case by case basis. There may be circumstances in which Cargill is not legally required to comply with your request or because of relevant legal exemptions provided for in applicable data protection legislation.
